TERMS OF SERVICE

Terms of Service

These Terms of Service (“Terms”) set out the conditions for using the iOS application “Train Net” (the “App”) provided by its developer (the “Provider”). By downloading or using the App, you agree to these Terms.

1.Scope

  1. These Terms apply to all relationships between the Provider and users regarding the use of the App.
  2. Individual notices and guides published in the App or on this site form part of these Terms.

2.What the App does

  1. The App estimates and records railway ride segments based on location data such as GPS, and displays them on maps and in statistics.
  2. The App’s records are estimates derived from positioning results. Depending on signal conditions, vehicle movement and data quality, detected segments may differ from your actual ride.
  3. The railway and station data included in the App is built from OpenStreetMap, public transport open data (GTFS) and similar sources, and may differ from actual operations.

3.Requirements

  1. The App requires a device running a supported version of iOS.
  2. Recording rides requires permission to use the device’s location services. Without it, the recording feature is unavailable.
  3. Some or all features may not work correctly depending on network conditions, power-saving settings and positioning accuracy.

4.Paid plan (Pro)

  1. The App offers a paid plan, “Pro” (auto-renewing subscription or one-time purchase), that unlocks additional features. Contents and prices follow the listings in the App and on the App Store.
  2. All purchases, billing, cancellations and refunds are handled through Apple’s App Store. You can cancel a subscription at any time in iOS Settings; unless cancelled, it renews automatically at the end of each period.
  3. Refunds are at Apple’s discretion. The Provider cannot issue refunds directly.

5.Your data

  1. Ride records are stored on your device. If you use Pro’s iCloud sync, they are also stored in your own private iCloud space.
  2. The Provider does not guarantee recovery of records lost through device failure, loss, or deletion of the App.
  3. Handling of personal information is governed by the separate Privacy Policy.

6.Prohibited conduct

When using the App, you must not:

  • violate laws or public order;
  • create records by spoofing location data or other fraudulent means;
  • reverse engineer, decompile or disassemble the App (except where permitted by law);
  • extract, copy or redistribute the data included in the App beyond its intended use;
  • interfere with the operation of the App, or engage in any other conduct the Provider reasonably deems inappropriate.

7.Safety

  1. Operate the App only when it is safe to do so — not while walking, boarding, or standing near the platform edge.
  2. Always follow the instructions of railway staff and the rules and conditions of carriage of each operator. Dangerous behavior in pursuit of records (such as entering restricted areas) is strictly prohibited.

8.Intellectual property

  1. Copyrights, trademarks and other intellectual property rights in the App and this site belong to the Provider or their rightful owners.
  2. License notices for open data and open-source software used by the App are listed on the “Licenses” screen in the App.

9.Disclaimer

  1. The Provider does not warrant the accuracy, completeness or fitness for a particular purpose of the App’s records and detections.
  2. Except in cases of intent or gross negligence, the Provider is not liable for damages arising from use of, or inability to use, the App. Where mandatory consumer protection laws apply, those laws prevail.
  3. Where the Provider is found liable, its liability is limited to the amount you paid for the App in the preceding 12 months.

10.Changes and termination of service

  1. The Provider may change the App’s content, add or remove features, or suspend or terminate the service without prior notice.
  2. Liability for damages caused by termination is governed by Section 9.

11.Changes to these Terms

  1. The Provider may amend these Terms when necessary. Material changes will be announced on this site or in the App.
  2. Continued use of the App after a change constitutes acceptance of the amended Terms.

12.Governing law and jurisdiction

These Terms are governed by the laws of Japan. Any dispute arising in connection with the App shall be subject to the exclusive jurisdiction of the court having jurisdiction over the Provider’s location as the court of first instance.
